Illegittima e anti-concorrenziale
Per il trattamento delle malattie oftalmiche "vi è, di fatto, un rapporto di sostituibilità tra il Lucentis e l'Avastin utilizzato off-label". Lo rileva la Corte di giustizia europea che, chiamata a pronunciarsi sulla questione dal Consiglio di Stato a cui si erano a loro volta rivolte le aziende produttrici dei due farmaci, ritiene come "l'intesa tra i gruppi farmaceutici Roche e Novartis volta a ridurre l'utilizzo in ambito oftalmico del medicinale Avastin e a incrementare quello di Lucentis potrebbe costituire una restrizione della concorrenza 'per oggetto'".
Un'intesa, secondo la Corte Ue, "effettivamente illegittima, come già ritenuto nel 2014 dall'Antitrust".
E' nel 2014 che esplode il caso Avastin-Lucentis, medicinali prodotti dalla società Genentech, appartenente al gruppo Roche e che ha affidato lo sfruttamento commerciale di Lucentis al gruppo Novartis con un accordo di licenza. Questo farmaco biotecnologico è autorizzato per il trattamento delle malattie oftalmiche, mentre Avastin, commercializzato da Roche, è autorizzato solamente come anti-cancro. In virtù del prezzo inferiore rispetto a Lucentis, però, è stato spesso utilizzato anche per il trattamento delle malattie oftalmiche.
Qui sta il nodo del contendere, che porta l'Autorità garante della concorrenza e del mercato a intervenire.
