Rubino: siamo soddisfatti, la Corte ha accolto le nostre tesi
Dopo 7 anni di processi e ricorsi, con sentenza n. 67/14, la Corte di Cassazione, a Sezioni riunite, ha totalmente accolto i motivi del ricorso proposto da Fimmg nei confronti della Provincia di Bolzano.
Nel 2007 Fimmg, nelle persone dei rappresentanti provinciali, ricorreva al Giudice del Lavoro di Bolzano, e questo accoglieva il ricorso presentato, chiedendo che fosse dichiarata la nullità dell’Accordo Provinciale per la disciplina dei rapporti con i Medici di Medicina Generale dell’11.12.2007, e la disapplicazione di provvedimenti e atti posti in essere dall’amministrazione in esecuzione di esso, ritendendo che una serie di disposizioni violavano quelle previste nell’ACN del 25.01.2005.
La decisione del Giudice del Lavoro era stata subito impugnata dalla giunta provinciale, che la riteneva un attacco alle competenze provinciali, e la Corte d’Appello accoglieva l’impugnazione.
La Corte di Cassazione ha ora sentenziato, definitivamente, che l’interpretazione data dalla sentenza di primo grado era corretta, stabilendo che la potestà della Provincia di Bolzano nelle materie “igiene e sanità, ivi compresa l’assistenza sanitaria ed ospedaliera” “ha carattere concorrente con la potestà dello Stato e deve essere esercitata, oltre che in armonia con la Costituzione e dei principi dell’ordinamento giuridico dello Stato, nei limiti dei principi stabiliti dalle leggi dello Stato”.
La Corte conclude che le disposizioni contenute negli Accordi Collettivi Nazionali “costituiscono principi fondamentali cui la legislazione provinciale è tenuta ad uniformarsi e che il contenuto degli accordi, dalle convenzioni stesse previsti, rappresenta principio generale di regolazione del rapporto convenzionale dei medici di medicina generale a livello nazionale.”
Dunque, le convenzioni triennali che hanno ad oggetto “l’erogazione delle prestazioni essenziali nella Provincia di Bolzano”, possono regolare autonomamente gli aspetti collaterali a quelli già definiti con gli accordi nazionali ma non possono contraddire le disposizioni contenute negli accordi stessi.
“Esprimiamo grande soddisfazione per la pronuncia della Corte – dichiara Luigi Rubino, Segretario della Fimmg Bolzano – abbiamo tenuto per anni un comportamento coerente e continuato a credere nella nostra tesi. La sentenza interviene con estrema chiarezza in una materia molto conflittuale come quella della potestà legislativa concorrente e diventa un punto fermo nei rapporti tra Stato e Regioni”.
